DUI Penalties And Sentencing In Georgia

Georgia takes DUIs very seriously, so it is important to implement a proactive defense as soon as possible once you are charged. A conviction for a first DUI can lead to:

  • Minimum $300 and up to $1,000 in fines
  • 24 hours in jail
  • 40 hours of community service
  • Lengthy probation
  • License suspension up to one year

The consequences for subsequent DUIs (second, third, fourth and so on) become significantly harsher. Even a second offense makes the consequences increase to:

  • Minimum $600 and up to $1,000 in fines
  • At least 48 hours in jail, and up to one year in jail depending on the circumstances
  • Even longer probation period
  • License suspension from 1½ to three years
  • Potential installation of an ignition interlock device in your vehicle
  • Potential for court-ordered treatment

Conviction on more than two DUIs in five years can brand you as a habitual violator, which leads to significant license revocation periods and makes it very difficult to get your driving privileges back.
